If you want your first public contract and don't know where to start, the answer is almost always the same: the electronic direct award (dispensa eletrônica). It's where the paperwork is leanest, the values are smaller, competition is minimal and the whole process wraps up in a few days. It's also where Brazilian microbusinesses win, every single day, the technical capacity certificates (atestados de capacidade técnica) that later unlock large contracts.

The trade-off is speed. The notice stays up for only a few days and then disappears. Those who check new publications daily get to take part; those who look once a week find the opportunity after it has already been ratified for another supplier. This guide explains what a direct award is, when it's allowed, how to participate and how to set up the routine that gets you there in time.

What a direct award is

A direct award (dispensa de licitação) is not an absence of rules — it's an absence of a formal competitive procedure. Law 14,133/2021 (Brazil's Public Procurement Law) lists situations in which the government may contract directly, without the full procedure of a reverse auction (pregão) or competitive bidding (concorrência), because the cost and delay of the procedure wouldn't be justified. Even so, the contracting remains public: a notice is published, proposals are received, there is a selection criterion and the result is published on the PNCP (Brazil's National Public Procurement Portal).

The most common case is the value-based direct award: smaller purchases of goods and services, and engineering works and services up to a higher limit, both adjusted annually by decree. Instead of a reverse auction that would take more than a month, the agency publishes an electronic direct award notice, receives proposals for three business days and contracts whoever offered the best price.

There are other relevant cases. An emergency or public calamity authorizes immediate contracting for as long as it takes to resolve the situation. A deserted or failed tender allows direct contracting under the same conditions as the tender notice (edital) that fell through — a steady source of opportunities for anyone who tracks results. There is also the purchase of fresh produce and perishables for the time needed to run a tender, the contracting of the remaining portion of a contract after it is terminated, and cases related to national security and international agreements.

Why the direct award is the best entry point

Competition is small. While a reverse auction for office supplies in a state capital draws twenty proposals, a direct award for the same items in a mid-sized city usually gets three or four. The lower value doesn't interest the large distributors, and the short deadline keeps away anyone who doesn't check daily.

The paperwork is reduced. The law allows much of the qualification (habilitação) requirements to be waived in low-value contracts. Many notices ask only for proof of tax and labor compliance, with no balance sheet and no technical capacity certificate — exactly the two requirements that keep new companies out of larger tenders.

The cycle is fast. From notice to commitment note (empenho) usually takes two to three weeks, compared with two months for a reverse auction. For a business that needs cash flow, that makes a real difference.

And it generates the most valuable asset. Once delivery is complete, you request the technical capacity certificate. With two or three certificates in your folder, tender notices that used to be out of reach become winnable. It's the path virtually every established company in the public market has followed.

How the electronic direct award works in practice

The procedure has been standardized and now runs on an electronic system, which has increased transparency and broadened its reach — in the past, it was common for the agency to simply ask three suppliers it already knew for quotes.

Publication of the notice. The agency publishes on the PNCP and on its chosen system (Compras.gov.br, the federal e-procurement system, or a private platform) the item, quantity, delivery location, deadline and estimated value. The notice usually stays open for three business days.

Proposal submission. You enter your price and, when required, the brand, model and attachments. The system keeps proposals confidential until closing.

Bidding phase or best offer. Depending on the system, there is a short bidding period, or the lowest proposal submitted simply wins. Read the notice: this information changes your pricing strategy.

Evaluation and qualification. The contracting agent (agente de contratação) reviews the winning proposal and the required documents — usually only tax and labor compliance.

Result and contracting. Once the result is published on the PNCP, the commitment note or a simplified contract follows, and the supply order starts the delivery clock.

The routine that gets you there in time

Because a notice lives only a few days, monitoring has to be daily and quick. The routine that works takes less than ten minutes:

Define five to ten keywords for what you sell, including the synonyms government agencies tend to use — "gêneros alimentícios" (foodstuffs) as well as "alimentos" (food), "material de expediente" as well as "material de escritório" (both meaning office supplies). Every business day in the morning, run these searches filtering for open direct awards in your state or in the region your logistics can reach. Open only the ones that pass the usual three filters: compatible value, workable deadline, feasible delivery.

On Busca Licitações, you can do this straight from the search: see the direct awards open right now or filter by your product category and your state. Each listing shows the time remaining, the estimated value, the list of items and the published documents.

It's also worth tracking results, not just openings. A failed or deserted reverse auction often turns into a direct award within a few days, with the same specification — and whoever has already studied the original notice shows up with a price ready while everyone else is just starting to read.

How to price a direct award proposal

The logic is the same as for any contract — actual cost, taxes, freight, the cost of the payment term and margin — with two particularities.

First: the volume is small, so fixed costs weigh proportionally more. A R$ 3,000 delivery 200 km away can carry freight that eats up half the margin. Calculate the actual freight, not an estimate.

Second: since the competition is short and sometimes has no bidding round, your first price already needs to be competitive. There's none of the reverse auction dynamic where you start high and adjust. Enter a price you'd be willing to close at — because you'll probably close at it. The complete methodology is in how to price your bid when selling to the government.

Contract splitting: the limit the agency must respect

One point that confuses newcomers: the direct award value limit applies per type of purchase over the fiscal year, not per individual purchase. The agency cannot break a large purchase into several small direct awards to avoid a reverse auction — that is improper contract splitting and makes those responsible liable.

For suppliers, this is useful for two reasons. First, it prevents mistaken expectations: if the city government has already used up the limit for that type of purchase in the year, further purchases will go to a reverse auction. Second, it helps you anticipate the calendar — anyone who follows an agency's purchasing history can predict when an item will move from direct award to reverse auction and prepare in advance. Each agency page shows this history.

Documents commonly requested

It varies from notice to notice, but the typical direct award package is short:

Note what usually does not appear: balance sheet, financial ratios, technical capacity certificate, bid bond. It's precisely this absence that makes the direct award accessible to newcomers. The complete list of what can be required in larger tenders is in qualification documents.

Value-based direct award, sole-source award and reverse auction: the differences that matter

These three mechanisms are often confused, and the confusion costs you reading time on tender notices that aren't relevant to you.

In a direct award, competition would be possible, but the law allows the formal procedure to be skipped for reasons of value, urgency or circumstance. There is still competition: several companies submit proposals and the best one wins. This is the scenario described in this guide.

In a sole-source award (inexigibilidade), competition is not feasible: an exclusive supplier proven by a certificate of exclusivity, an artist acclaimed by critics or the public, or a specialized technical service from a provider of recognized expertise. There is no price competition — the agency justifies the choice and the price. For the typical supplier, this is the least accessible route, because it depends on a condition you either have or you don't. See the published sole-source awards to understand the pattern.

In a reverse auction, there is a full procedure: tender notice, longer deadline, bidding phase, detailed qualification. This is where the larger contracts are and where good document organization makes a difference. The natural path is to start with direct awards and move on to reverse auctions once your document folder and certificates are ready — the step-by-step is in electronic reverse auctions step by step.

How much you can earn from direct awards alone

It depends on your industry and region, but the numbers are more encouraging than they look. A mid-sized municipality publishes dozens of direct awards a month, each worth anywhere from a few thousand to a few tens of thousands of reais. A company that follows three or four neighboring municipalities and masters a specific category usually finds relevant opportunities every week.

The secret isn't winning them all — it's taking part in many with a calculated price and winning a consistent share. Since the cost of participating is low (ten minutes of monitoring, plus the time to put the proposal together), the math works even with a modest success rate.

One mistaken expectation worth correcting: public contracts won't replace private-sector revenue overnight. They complement it, add predictability and, above all, build the track record that opens the door to larger contracts the following year. Treat the first year as groundwork.

What to watch for at delivery

Direct awards usually involve simple execution, but a few precautions spare you trouble. Confirm the exact delivery address — it's not unusual for it to be a warehouse in an outlying district rather than city hall. Check the receiving hours: many agencies only accept deliveries during certain shifts. Issue the invoice with the correct details, including the commitment note number and the case number, because an incorrect invoice holds up payment.

On delivery, insist on a signed proof of receipt and keep it. If any item is rejected for not matching, sort it out immediately: a quick replacement is usually accepted without a sanction, while a delay turns into a warning. And once everything is done, request the technical capacity certificate describing the item, the quantity and the deadline you met.

Mistakes that cost you easy direct awards

Frequently asked questions

Is a direct award less transparent than a reverse auction?

No. The notice, the proposals, the winner and the price all go to the PNCP, and anyone can look them up. What changes is the procedure, not the publicity.

Can any company participate?

Yes, as long as it meets the requirements of the notice. In lower-value purchases, participation may be restricted to ME/EPP under Complementary Law 123/2006 (Small Business Statute) — which favors newcomers even more.

Do I need to register on a paid platform?

It depends on where the agency publishes. Many direct awards run on Compras.gov.br, which is free. Others use private platforms that charge a fee. Start with the free ones and consider a subscription once you notice that agencies in your region frequently use a particular platform.

Are emergency direct awards worth it?

They can be, but they demand extra care: extremely tight deadlines, immediate delivery and strict oversight, because emergency contracts are the most heavily audited. Only get involved if you're sure you can deliver.

After winning a direct award, do I get preference in future ones?

Not formally — each contract is independent. In practice, performing well has two effects: the certificate that qualifies you for larger tenders and the trust of the purchasing department, which starts including your company in its price surveys.

Start today

Choose an item your company sells every day, put together your folder of certificates, register on Compras.gov.br and block out ten minutes a day on your calendar to review the direct awards in your line of business. See what's open right now in direct awards and, if you'd rather filter by what you supply, start with the public procurement categories.

The first contract is usually small — a few thousand reais, simple delivery, little red tape. That's exactly what you need: it pays for the learning curve and delivers the certificate that opens the next door.
