Direct award and sole-source procurement: when the government buys without a tender

The cases of direct contracting, how the value thresholds work (updated every year) and why the electronic direct award is the best entry point for small businesses.

Not every public purchase goes through a reverse auction. Law 14,133/2021 (Brazil's Public Procurement Law) provides for direct award (dispensa de licitação), when the tender is waived, and sole-source award (inexigibilidade), when it is not feasible. They add up to an enormous volume: thousands of notices a day, with far less competition than reverse auctions. For a small company, it is the shortest path to a first contract.

Direct award by value

This is the most common case. The agency may directly contract low-value purchases and services, and engineering works and services up to a higher limit, both adjusted yearly by decree. Even without a formal tender, the procedure is public: the agency publishes the notice, receives proposals (usually electronically, within a short window of three business days) and publishes the result on the PNCP (National Public Procurement Portal).

Beware of splitting: the limit applies per object in the fiscal year, not per purchase. The agency cannot split a large procurement into several direct awards.

Other grounds for direct award

Sole-source award

Here competition is unfeasible, not merely waived. The three classic cases: an exclusive supplier (proven by a certificate of exclusivity), an artist acclaimed by critics or the public, and specialized technical services of a unique nature provided by a professional of renowned expertise. The justification and the price survey must be in the case file — a sole-source award is no free pass.

Why the electronic direct award pays off

The short deadline keeps many companies away; the lower value doesn't interest the big ones; and the process is simple, with reduced documentation. An electronic direct award (dispensa eletrônica) commonly gets three or four proposals, against twenty in a reverse auction for the same object. For beginners, it's where you earn your first technical capacity certificate (atestado de capacidade técnica) — the document that later opens the doors to larger contracts.

The trade-off is speed: the notice usually stays open for only a few days. Those who follow publications daily can respond; those who check once a week miss out.
